Constitutional Law-2
-
This module dealt with the Sixth Amendment. Explain in your own words the four main features of the Sixth Amendment right to counsel.
-
The Sixth Amendment restrictions on the conduct of the police include the following five areas. Explain how these restrictions may impede police conduct.
Pretrial encounters during which the accused is entitled to have a lawyer present.
Precautions police must take to secure a valid waiver of the Sixth Amendment right to counsel.
An officer’s obligation to secure appointed counsel for defendants who cannot afford a lawyer.
The degree to which police must permit defense attorneys to play an active role during police procedures in which the defendant has a right to have a lawyer present.
Conduct considered an improper intrusion into the attorney-client relationship.
Explain when, if ever, a court must appoint counsel before compelling an indigent defendant to appear in a pretrial lineup. Must it be before or after showing the defendant’s photograph to an eyewitness?
Along these same lines, what must a defendant establish in order to have his or her conviction overturned on the basis of ineffective assistance of counsel? Do you agree with the standard? Why or why not?
