    The Case

    Case Notes:

    This case shocked parents everywhere. The suspect was a “callous liar” and had

    been sent to therapy when he was 12 when his parents realized he was viewing child

    pornography. He was interested in mortuary science and at one time had convinced

    his mother to help him practice restraining someone with zip ties. (Denver Post,

    2013)

    Evidence details twisted path that led Austin Sigg to Jessica Ridgeway

    Crime Scene Photo: The victim, Jessica Ridgeway, was a 10-year-old girl. She

    attended elementary school in Westminster, CO. She did not know her attacker,

    although he lived a little more than a mile away. (Denver Post, 2013)

    Suspect Photo: Austin Sigg, 17, grabbed Jessica as she walked across a street in

    her neighborhood and he took her to his home where he raped, strangled her to

    death and then dismembered her body. (Denver Post, 2013)

    Juvenile Court: The DA bypassed juvenile court altogether based upon the crime.

    Austin Sigg’s case was directly filed by the district attorney in adult court.

    Juvenile Justice

    Colorado Juvenile Courts

    Charging Juveniles

    In Colorado, you can be charged with a crime starting at age 10. This age varies

    from state to state. There are also different methods in which a juvenile can be

    transferred to adult court. An example is the Austin Sigg’s case. The first method is a

    transfer hearing in which the juvenile judge decides whether to bind over to the adult

    court and the second is a direct filing in which the district attorney decides to file a

    case directly. In the case of Sigg, the district attorney “directly filed” the case.

    Sentencing Juveniles

    It used to be common to sentence juveniles to life in prison without parole and this is

    documented in the Frontline Special When Kids Get Life. The Supreme Court

    ultimately decided this was cruel and unusual punishment.

    Juveniles & Parole

    If you commit first degree murder in Colorado as a juvenile, you are automatically

    up for parole after forty years. This does not mean you will receive parole but you

    are eligible for parole. Juveniles are also not eligible for the death penalty based

    upon a Supreme Court ruling Roper v. Simmons.

    War on Drugs

    War on Drugs

    Strict enforcement

    A feel-good approach that has cost a fortune to sustain but that has done little to

    reduce the use and manufacture of controlled substances.

    Asset forfeiture

    An aggressive approach that yields great monetary return but often ensnares truly

    innocent property owners.

    Crop control

    Theoretically a good idea, but in practice more show than substance. Major obstacles

    include the inability to overcome the potentially huge profits for farmers of illegal

    plants and difficulties involved in getting foreign governments to cooperate in

    eradication efforts.

    Education and treatment

    Seen by some as the key to resolving the drug problem but are inherently long-term

    solutions that do little to reduce the problem now.

    Legalization or decriminalization

    An approach that would likely reduce criminal justice expenditure, with

    commensurate expenditure increases for health care and attendant problems. Some

    say, however, that the additional costs to society resulting from erosion of the social

    and moral fabric would be immeasurable, making this the least attractive strategy.

    Interdiction

    An almost futile effort to seal the borders of the United States to drug shipments.
