The Foreign Intelligence Surveillance Act, 50 U.S.C. § 1861, previously authorized US government to monitor and collect business phone records involving national security. 

Background

The Criminal Case

The defendants in this case were indicted in June of 2012 on five counts related to providing financial support to al-Shabaab, a Somali militia group that was designated as a Foreign Terrorist Organization by the U.S. State Department on February 26, 2008. During the lower court proceedings, the defendants filed motions to suppress evidence collected pursuant to warrants and electronic surveillance orders issued under the Foreign Intelligence Surveillance Act, which the court denied. The defendants also requested that their security-cleared counsel be granted access to pertinent FISA applications and related materials in order to prepare their legal and constitutional defenses. The defendants were ultimately convicted by a jury on February 22, 2013.

Following the conviction, it was revealed in June 2013 that the National Security Agency (NSA) had been collecting all domestic and international telephone metadata from major US providers for more than ten years. During congressional hearings before the House Permanent Select Committee on Intelligence following the Snowden revelations, the Deputy Director of the FBI specifically cited the Moalin case as an example of an investigation where the NSA Metadata program had been used to identify the suspect. The defendants subsequently filed a motion for a new trial pursuant to Federal Rule of Criminal Procedure 33 on November 14, 2013, based on the NSA revelations and the government’s failure to produce evidence related to the pertinent FISA court applications and materials. In particular, Mr. Moalin argued that the FBI had only reopened his case in 2007 as a result of a tip generated by the NSA Metadata program.

The court denied the defendants’ motion for a new trial. The defendants subsequently filed an appeal to the Ninth Circuit, which is currently pending.

The following cases involve electronic surveillance within the United States. 

Riley v. California, 134 S. Ct. 2473 (2014); Clapper v. Amnesty Int’l USA, 133 S.Ct. 1138 (2013); United States v. Jones, 132 S.Ct. 945 (2012); United States v. Ganias, No. 12-240 (2d Cir.); In re National Security Letter, Nos. 13-15957 & 13-16731 (9th Cir.); In re US Application for CSLI, 724 F.3d 600 (5th Cir. 2013); State v. Earls, 70 A.3d 630 (N.J. 2013); Commonwealth v. Connolly, 913 N.E.2d 356 (Mass. 2009).

This case is about National security.  As the United States government has a role to protect the county from acts of terrorism.  If this information obtained is only used for those purposes it would be great.  But the reality is that there is no perfect system.  Overall, I would rather them monitor for my safety, but I have concerns about my privacy being invaded.

Begin your project with a clear, focused thesis statement.  Address the origins, region, main leaders, the particular teachings/philosophies, rituals, scriptures, holy days/holidays, and impact of the religions. Use the categories and terms from chapter 1 in your descriptions of the religions.

b. In a paper, Write a dialogue between two of the following: Moses, Jesus, Muhammad. Begin your project with a clear, focused thesis statement.  Address these points: origin/birth; what led to their ethical system; what is their ethical system; what was the response to this system. Compare and contrast their teachings/philosophies. Use the terms and concepts from Chapter 1 to inform your research and presentation.

c. Write a paper in which you present a visual report on two (2) Western religions sites nearby [at least one has to be either Judaism or Islam]. An alternative for those in rural places would be to do an Internet search of two religious locations. Begin your project with a clear, focused thesis statement. Look at architecture, interior space, etc. Include visuals to illustrate your points. How do these reflect the definitions and terms of Chapter 1 and what we have learned about these religions? 

d. Conduct an extensive interview with a person who practices Western religions, the Sikh faith, or New Religious Movements and write a paper presenting the results of this interview. Begin your project with a clear, focused thesis statement. Use these questions in your interview: How did you become associated with this religion? What is it about this religion that intrigues you? Is it difficult to practice your faith? What readings/scriptures do you use? What are some rituals you perform? What holy days/holidays do you keep? What would you like your neighbors/colleagues to know about your faith? Use the definitions and categories of religion from Chapter 1 to guide the interview.
 

e. Write a paper that explores religion in the news. Find an extensive news story on one Western religion or one of the New Religious Movements. Begin your project with a clear, focused thesis statement. Using 5 (five) terms and concepts from Chapter 1 and pertinent chapters from Fisher, interpret that story for people at a family gathering by explaining how it relates to the basic tenets of that faith tradition

Write a two to three (2-3) page paper in which you:

What are New Religious Movements? Old religions turned new? Are they legitimate? How do they address the social changes of our modern world?

The writer of the biblical book of Ecclesiastes says, “There is nothing new under the sun.” Many believe that, for the most part, New Religious Movements (NRMs) are just rehashes of old religions.

I believe NRM’s are old religions with a new twist. The example I provide is The Church of Jesus Christ Latter day Saints.  The church was found by Joseph Smith in 1805 who was said that he started receiving messages from God who then became a prophet. The Church recognizes the old testament and new testament of Jesus and Christianity but then also follow the book of Mormon, doctrine of covenants and the pearl of Great price which are all findings and book written by Smith based on religious encounters with God.  The Church of Jesus Christ Latter Day saints encompasses Christianity and with the documents and teaching of Smith added to Christianity.

Or, are NRMs legitimate religions that, according to Chapter 1, fulfill spiritual needs for a new generation and new times? What are these needs? What changes in our world are they reacting to?

Trying to keep an open perspective on this since my base religion is Christianity, I would have tend to say that so that NRM’s are not legitimate, however based on the information provided in our text book religions are based on a belief of a God or higher being so I believe it is still fundamental to believe in our past history of religious beliefs and experiences, however as time changes people need to a religion to relate to rather than something that happened many years ago. I believe people are reacting to what is happening today and not to mention today we are obsessed with finding facts about historical events and things that occurred in the past cannot be explained but only through belief.

Finally, in your informed opinion, have the old religions let us down? Are they obsolete?

I don’t believe that old religions have let us down. I believe they are the foundation and history that led us to where we are today. I think there is much to learn from Religion and its history and to make sure we are living and treating everyone equally otherwise I don’t think we would be still learning about religions today.

I believe as humankind evolves, I believe more foundations for “religious houses” because in some religions we are being taught that although you go to Church to worship you can’t worship outside of the Church as well.

I chose topic 1:Discuss Sept 11(2001) attack and its impact

Describe what stands out to you (perhaps from memory) from the events of Sept. 11, 2001

What stands out to me is how the US government knew about this attack 6 months in advance, why didn’t they inform the American public and or done something about it before it got to what it got to;maybe so innocent people wouldn’t have lost their lives all because the government reneged on a deal that they had made with the leader Bin Laden.

Give two examples of events or changes since 9/11 that you attribute to that terrorist attack. In your view, what should we learn from this attack and our experiences trying to deal with it.

Oil prices and Changes to air travel and safety….I think that America needs to take security just a little more serious and let it be efficient in a way that nobody gets frustrated with the wait times and that more security needs to be taken just a little bit more serious at bus and train stations. So that we don’t have yet another 9/11 attack and the lives of American citizens needs to be taken a little more serious.
